Terms of Service

Real Estate Review Cards ("Company," "we," "our") provides a software platform that enables licensed real estate professionals ("Users") to generate, customize, and mail personalized property review postcards to homeowners. The platform uses automated data analysis, AI-assisted commentary, and third-party property data to generate estimated value ranges and market summaries.

Users agree to comply with all applicable fair housing laws, including the Fair Housing Act, at all times. The platform is designed to provide property-based market analysis only. Users shall not:

• Use the platform to target or exclude individuals based on race, color, religion, sex, national origin, disability, familial status, or any other protected class
• Generate or distribute content that violates fair housing laws
• Use demographic or neighborhood-composition data for any discriminatory purpose

Violations of fair housing laws may result in immediate account termination and referral to appropriate authorities.

Users who are licensed real estate professionals agree to:

• Ensure all printed cards include required agent identification (name, brokerage, and license number where required by applicable state law)
• Comply with all applicable state real estate commission rules governing marketing and advertising
• Obtain all necessary brokerage approvals before distributing marketing materials to consumers
• Not misrepresent property values or market conditions to consumers
• Review and approve all cards before authorizing print production

• Users are solely responsible for ensuring they have lawful authority to upload and use contact information
• Users must comply with CAN-SPAM, TCPA, state mail marketing laws, and all applicable privacy regulations
• Users must honor all Do Not Mail and opt-out requests
• Users shall not upload contact lists obtained through deceptive or unlawful means
• Users are responsible for reviewing all postcards for accuracy before approving them for production
• Users shall not use the platform for any unlawful purpose

Users retain ownership of content they upload (photos, logos, branding). By uploading content, Users grant Real Estate Review Cards a limited license to use such content solely to provide the service.

Users represent and warrant that they own or have the necessary rights to all uploaded content. Real Estate Review Cards respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

DMCA Takedown Notice: If you believe your copyrighted work has been used without authorization, submit a DMCA notice to: dmca@realestatereviewcards.com including: (1) identification of the copyrighted work; (2) identification of the infringing material and its location; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; (6) your signature.

Real Estate Review Cards sources property data from third-party providers including ATTOM Data Solutions and public records. We do not guarantee the accuracy, completeness, or timeliness of any data. Property records may contain errors. Users acknowledge that:

• Data may be outdated, incomplete, or inaccurate
• Third-party data providers may have their own limitations and disclaimers
• Property values change continuously and estimates may not reflect current conditions

Payments are processed through Stripe. Charges are incurred when data pulls are initiated and when print production begins. All charges are non-refundable once print production has commenced. Subscription fees are billed in advance and are non-refundable for the current billing period except as required by law.

The platform is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the platform will be error-free, uninterrupted, or free of viruses or other harmful components.

To the maximum extent permitted by law, Real Estate Review Cards, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of goodwill, business interruption, property damage, or any damages arising from reliance on AI-generated valuations or property estimates, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from use of the platform shall not exceed the amounts paid by you in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Real Estate Review Cards and its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the platform; (c) your violation of any third-party rights; (d) your violation of any applicable law; or (e) any content you upload or distribute through the platform.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Denver, Colorado.

Your use of the platform is also governed by our Privacy Policy, which is incorporated herein by reference. You consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

You may request deletion of your account and associated data at any time by contacting support@realestatereviewcards.com. We will process deletion requests within 30 days. Certain data may be retained as required by law or for legitimate business purposes (e.g., audit logs, billing records). You may also request a copy of your data in a machine-readable format.

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or in-app notification. Continued use of the platform after the effective date of revised Terms constitutes your acceptance. The current version number and effective date are displayed at the top of this page.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct we determine to be harmful to the platform or other users. You may terminate your account at any time. Termination does not relieve you of obligations accrued prior to termination.
